Terms of Service.

The deal between you and us. Plain English, no nasty surprises.

1. About these terms

These terms are an agreement between you and [Operator name — to be completed](“we”, “us”), who operate Festipal at festipal.app. By creating an account or using Festipalyou agree to them. If you don’t, please don’t use the service.

2. Who can use it

You must be 18 or over to create an account and hold a box. You’re responsible for your account and for keeping your password safe; let us know if you think someone else has got into it.

3. What Festipal is

Festipal is a shared festival memory box. A holder creates a box for a festival and brings a crew (members) and free followers. Everyone shoots a shared disposable camera and logs the bands; when the box closes, it all develops. It’s a keepsake, not a safety or logistics tool — please don’t rely on it for anything critical.

4. Subscriptions & payment

Festipalhas a free tier and paid annual passes (Pro at £19.99/year and Pro+ at £24.99/year). A paid pass covers every box and crew you run that year. Payments are taken securely by Stripe. Prices include VAT where it applies; we’ll always show the price before you pay, and tell you in advance of any change.

During our launch period some or all paid features may be free — that’s a goodwill offer we can change or end at any time, and it doesn’t create an ongoing right to free service.

5. Cancelling & refunds

You can cancel any time from your account; you’ll keep your paid features until the end of the period you’ve paid for. As this is digital content supplied online, you have a 14-day right to cancel under the Consumer Contracts Regulations 2013 — but if you ask us to start (or you start using paid features) within that window, you agree you lose that cancellation right once we’ve begun. Nothing here affects your legal rights if the service is faulty or not as described.

If your pass lapses, you simply can’t record newfestivals on a paid tier — the boxes you’ve already made stay yours and fully accessible.

6. Your content

Your photos, videos, notes and everything else you add stay yours. You grant us a limited licence to host, store, process and show that content to the crew you choose — purely so we can run the service for you (for example, developing the roll or stitching the one-second film). We don’t claim ownership and we won’t sell it.

You’re responsible for what you upload: only add content you have the right to share, and be considerate of people who appear in your photos.

7. Fair use

When using Festipal, please don’t:

  • break the law, or post content that’s illegal, hateful, harassing or infringes someone else’s rights;
  • upload anyone’s intimate images without consent, or content sexualising minors;
  • use it to promote or coordinate anything dangerous or illegal;
  • attempt to break, scrape, overload or reverse-engineer the service, or get around its access controls.

Festipal is about memories, not mischief. We can remove content or suspend accounts that break these rules.

8. Our bits

The Festipalname, design, code and content are ours (or our licensors’). We give you a personal, non-transferable right to use the service; that’s it.

9. Availability & liability

We work hard to keep Festipalrunning and your memories safe, but we provide the service “as is” and can’t promise it’ll always be available or error-free. Please keep your own copies of anything irreplaceable.

Nothing in these terms limits liability that can’t be limited by law (such as for death or personal injury caused by our negligence, or for fraud). Subject to that, and as a consumer service, we’re not liable for losses we couldn’t reasonably have foreseen, and our total liability is limited to the amount you paid us in the 12 months before the issue.

10. Ending things

You can close your account whenever you like. We may suspend or end access if you seriously or repeatedly break these terms, giving notice where we reasonably can.

11. Changes & governing law

We may update these terms from time to time; we’ll change the date above and flag anything significant. These terms are governed by the law of England & Wales, and disputes go to its courts. As a consumer you may also have the right to bring proceedings in your local courts.
